All time line bosses have an empowered only unique drop. The Argentum Spire area level is most likely a visual bug. Tap your Tab button a few times and it should say level 100. Increasing the rarity of mob drops has no effect on boss specific unique drops. They have a set drop rate and you can't affect it (to my knowledge anyway).
